These Terms and Conditions are issued by QDM (the “Issuer”), as defined herein.

For the sake of clarification, “Issuer” refers to Quality Digital Marketing. All obligations and rights under these Terms and Conditions apply solely to the Issuer.

These Terms and Conditions govern your purchase and participation in any paid digital course, program, or training offered by Issuer, collectively referred to as “Issuer,” “we,” “us,” or “our.”

By purchasing a course through our website, or at any live or virtual event, you agree to the following terms:

Definitions

“Course” or “Courses” means any paid digital program(s), training(s), or service(s) delivered by Issuer.
“Customer” or “you” refers to the individual or entity purchasing the Course.

Eligibility

You must be at least 18 years of age to purchase a Course. By registering, you confirm that you meet this requirement and are entering into a legally binding agreement.

Access & Delivery

Upon purchase, you will receive immediate access to the Course Materials unless otherwise stated. The Course Materials include forums, members’ sites, videos, and Zoom links. Course Materials are released progressively throughout the course. Access is considered delivery under applicable digital goods laws.

Professional Conduct

You agree to conduct yourself professionally at all times. Disruptive or inappropriate behavior may result in immediate removal and exclusion from future participation. This includes unauthorized promotions, defamatory remarks, misrepresentation, unlawful behavior, or anything disrupting the learning environment.

Intellectual Property

All Course materials are protected by copyright and may not be used, recorded, or distributed without written permission from the copyright holder. Recording events in any form is prohibited unless expressly approved.

Refund Policy

All sales are final except under the Cooling-Off Period and EU/UK Right of Withdrawal:

Cooling-Off Period (non-EU/UK): Refunds are allowed within 3 calendar days if you haven’t accessed more than one module or session. Request must be sent within this window.

EU/UK Right of Withdrawal: A 14-day statutory right applies unless you consent to immediate access and waive your right at checkout under Article 16(m) of Directive 2011/83/EU.

No refunds for dissatisfaction after course access, scheduling issues, or non-completion—unless covered by the Satisfaction Guarantee.

Satisfaction Guarantee

You may be eligible for a refund if you:

Complete 100% of the course and bonus trainings,

Wait 12 months after completion, and

Prove no return on investment using verifiable business records.

Requests must be submitted within 30 days of the 12-month mark with all documentation. Issuer may request additional information.

Payment Terms and Dispute Resolution

All fees are due at purchase or per the payment plan. Missed payments may lead to revoked access and collections. Contact us before initiating chargebacks. Issuer may provide evidence in disputes.

Disclaimers

Course content is for educational purposes only and is not professional advice. Issuer does not guarantee outcomes. Any examples or testimonials are illustrative and not promises. You are solely responsible for your actions and results.

Limitation of Liability

Issuer is not liable for indirect or consequential damages. Total liability is capped at the amount you paid for the Course.

Photos & Videos

By participating, you consent to being photographed or recorded. Issuer may use your likeness in marketing without further approval or compensation. You release Issuer from any claims related to this use.

Privacy and Data

Your data is processed under our Privacy Policy and relevant laws (GDPR, CCPA). By purchasing, you consent to receive communications from Issuer’s Brands. Data may be transferred internationally under approved safeguards.

Modifications

Issuer may update these Terms. Continued participation constitutes acceptance of changes. Course dates are subject to change for participant benefit at Issuer’s discretion.

Force Majeure

Issuer is not liable for delays or failures due to events beyond its control (e.g., natural disasters, technical issues, government actions).

Governing Law and Jurisdiction

These Terms are governed by SA law. Any disputes shall be resolved through binding arbitration in SA. If any part of these Terms is found invalid, the remainder remains enforceable. Issuer’s liability for non-excludable conditions is limited to the lesser of $5,000 or the amount paid.
